TERMS OF USE

2.1 Age Requirements: You must be at least 13 years of age to use the Services. If you are under 18 years of age, you must have permission from a parent or legal guardian to use the Services.

2.2 Capacity: You represent that you have the legal capacity to enter into this agreement and are not prohibited from using the Services under any applicable laws.

2.3 Account Accuracy: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

EduLearn provides the following key services across different platforms:

4.1 Account Creation: To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Wallet Generation (Web App Only): Upon registration, we automatically generate a Solana blockchain wallet for you. Your encrypted private key is stored securely in our database. This wallet and all associated blockchain features are accessible ONLY through the web application at edulearn.fun. You acknowledge that:

• Wallet features are NOT available on mobile applications (iOS/Android).
• You must use the web platform to access your wallet, view balances, and perform transactions.
• You are responsible for maintaining access to your account to access your wallet.
• We store encrypted private keys, but you should backup your wallet information.
• Loss of access to your account may result in loss of access to your wallet and associated assets.
• Blockchain transactions are irreversible once confirmed.

4.3 Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

4.4 Account Termination: We reserve the right to suspend or terminate your account for violation of these Terms or for any other reason at our sole discretion.

5.1 Web3 Services: EduLearn utilizes blockchain technology on the Solana network. You understand and accept the risks associated with blockchain technology, including but not limited to:

• Network congestion and transaction delays
• Gas fees and transaction costs
• Irreversibility of blockchain transactions
• Volatility of cryptocurrency values
• Potential for smart contract vulnerabilities
• Regulatory changes affecting cryptocurrency

5.2 EDLN Tokens: EDLN tokens are utility tokens used within the EduLearn ecosystem for in app purchases and incentives. EDLN tokens:

• Have no inherent monetary value and are not an investment
• Cannot be exchanged for fiat currency directly through our platform
• May be used for platform features, marketplace transactions, and premium content
• May have fluctuating value based on market conditions

5.3 NFTs: EduLearn may issue NFT badges and certificates for achievements. You understand that:

• NFTs represent digital proof of achievement on the blockchain
• Ownership of NFTs does not grant intellectual property rights to the underlying content
• NFTs may have zero monetary value and should not be considered an investment
• We reserve the right to modify NFT metadata and images with notice

5.4 No Investment Advice: Nothing in these Services constitutes financial or investment advice. We do not recommend purchasing, selling, or holding any cryptocurrency or NFT.

5.5 Tax Obligations: You are solely responsible for determining and paying any applicable taxes on cryptocurrency or NFT transactions.

6.1 AI Services: EduLearn uses artificial intelligence to generate educational content, quizzes, study plans, and tutoring responses. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or outdated information
• AI responses should be verified against authoritative sources
• AI is a learning aid and should not replace formal education or professional advice
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content

6.2 Educational Purposes Only: All content is provided for educational purposes only and should not be considered professional advice in any field.

6.3 User Verification: Users are encouraged to independently verify important information and consult qualified professionals when making decisions based on learned content.

7.1 Free and Premium Tiers: EduLearn offers both free and premium subscription plans with varying features and benefits.

7.2 Payment Processing: Subscription payments are processed through third-party payment processors:

• Mobile Apps (iOS/Android): Processed through RevenueCat, Apple App Store, and Google Play Store in-app purchases.
• Web Application: Processed through our web payment systems and may include cryptocurrency payment options.
• By subscribing, you agree to the respective payment processor's terms and conditions.

7.3 Billing: Premium subscriptions are billed on a recurring basis (monthly or annual) until canceled. You authorize us to charge your payment method for all fees.

7.4 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

7.5 Free Trials: Free trial periods may be offered for premium features. You may be automatically charged when the trial ends unless you cancel before the trial period expires.

7.6 Price Changes: We reserve the right to modify subscription prices with 30 days' notice to existing subscribers.

7.7 Refunds: All sales are final. Refunds may be issued at our sole discretion for technical issues or billing errors.

8.1 User-Generated Content: You may post, upload, or share content through the Services, including study materials, notes, comments, and community posts. You retain ownership of your content but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for operating and promoting the Services.

8.2 Content Standards: You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, or hateful
• Infringes on intellectual property rights of others
• Contains malware, viruses, or malicious code
• Is fraudulent, false, or misleading
• Violates the privacy of others

• Use bots, scripts, or automated tools to interact with the Services

• Scrape, harvest, or collect user data without permission
• Impersonate others or misrepresent your affiliation
• Share account credentials with others

8.4 Content Moderation: We reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion.

9.1 Our Content: Unless otherwise indicated, the Services and all content, including but not limited to text, graphics, logos, images, software, and educational materials, are the property of EduLearn or our licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial educational purposes.

9.3 Restrictions: You may not:

• Reproduce, distribute, or publicly display our content without permission
• Use our content for commercial purposes
• Remove or modify any copyright or proprietary notices
• Create derivative works based on our content

9.4 Trademarks: "EduLearn" and our logo are trademarks of EduLearn. You may not use our trademarks without prior written consent.

10.2 Data Security: While we implement security measures to protect your data, including encrypted storage of wallet private keys, no method of transmission over the internet is 100% secure. You use the Services at your own risk.

10.3 Data Retention: We retain your personal data for as long as necessary to provide the Services and comply with legal obligations.

10.4 Third-Party Services: The Services integrate with third-party services (Supabase, Google AI, Solana blockchain, payment processors). These providers have their own privacy policies and terms.

11.1 "As Is" Basis: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11.2 No Warranty: WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
• ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT

12.1 Maximum Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EDULEARN, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR USE
• LOSS OF CRYPTOCURRENCY, TOKENS, OR NFTs
• EDUCATIONAL FAILURES OR MISSED OPPORTUNITIES
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
• DAMAGES RESULTING FROM THIRD-PARTY SERVICES OR BLOCKCHAIN NETWORKS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

12.2 Blockchain Risks: You acknowledge and agree that we are not liable for any losses related to blockchain transactions, including but not limited to network failures, smart contract bugs, or changes in cryptocurrency values.

12.3 Force Majeure: We are not liable for failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, government actions, network failures, or power outages.

You agree to indemnify, defend, and hold harmless EduLearn and our subsidiaries, affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your content posted on the Services
• Your blockchain transactions or cryptocurrency activities
• Any fraudulent or illegal activities conducted through your account

14.1 Informal Resolution: In the event of any dispute, claim, or controversy, you agree to first contact us at legal@edulearn.fun to attempt to resolve the dispute informally.

14.2 Binding Arbitration: If informal resolution fails, any dispute will be resolved through binding arbitration rather than in court, except where prohibited by law.

14.3 Class Action Waiver: YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

• No refunds will be provided for unused subscription periods

16.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and EduLearn regarding the Services.

16.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.

16.5 No Agency: No agency, partnership, joint venture, or employment relationship is created between you and EduLearn as a result of these Terms or your use of the Services.

16.7 Language: These Terms are provided in English. Any translation is provided for convenience only, and the English version shall prevail in case of conflicts.
